Dahemik Terms and Conditions

Introduction

By downloading and using Dahemik ("the App"), you agree to comply with these Terms and Conditions ("T&C"). These T&C govern your access to and use of the App and the services provided by Dahemik ("we", "us", or "our"). If you do not agree with any of these terms, you may not use the App.

1. Eligibility
​

You must be at least 18 years old or of the legal age of majority in your jurisdiction to use the App. By using Dahemik, you affirm that you meet this requirement.

2. User Accounts and Data Collection
​

  • Account Creation: To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials.

  • Data Collection and Use: We collect and use personal information as described in our Privacy Policy. By using the App, you consent to the collection, use, and sharing of your personal data for operational purposes.

  • Data Protection: We take appropriate measures to safeguard your personal information. However, we cannot guarantee absolute security, and by using the App, you acknowledge and accept this risk.​

3. User Conduct and Responsibilities

  • Behavior: Users agree to use the App in a respectful and lawful manner and not to engage in any behavior that is harmful, abusive, or disruptive to other users.

  • Prohibited Activities: Users may not use the App for illegal activities, including but not limited to fraud, harassment, or the distribution of malicious software.

  • Reporting: Users are encouraged to report any misuse or inappropriate conduct within the App.

4. Sharing Items and Liability

  • Ownership and Risk: Users retain ownership of their items when sharing. Dahemik is not responsible for any loss, theft, or damage of items shared through the App.

  • Condition of Items: Users are responsible for ensuring that items shared are safe and in good working condition.

  • Disclaimer: Dahemik provides a platform for users to connect and share items. We do not supervise, verify, or endorse the items shared on the platform and bear no responsibility for the safety, quality, or legality of these items.

  • Liability Waiver: By using the App, you agree to release Dahemik from any liability for damages arising from transactions conducted through the App.

5. Connection and Interaction with Other Users
​

  • Personal Responsibility: You are responsible for your interactions with other users, both within and outside the App. We encourage users to engage responsibly and take precautions when meeting others or borrowing items.

  • Disputes Between Users: Dahemik is not liable for any disputes that may arise between users. Any resolution is the responsibility of the parties involved.

6. Content and Intellectual Property
​

  • User Content: By sharing content (including photos, descriptions, etc.) on Dahemik, you grant us a non-exclusive, worldwide license to use, display, and distribute your content within the App.

  • Proprietary Rights: All intellectual property, including trademarks, logos, and software, belongs to Dahemik. You agree not to copy, modify, or distribute our intellectual property without written permission.

7. Limitation of Liability

  • Disclaimer of Warranties: The App is provided "as is" and "as available." We make no warranties, express or implied, about the functionality, performance, or availability of the App.

  • Limitation of Damages: To the extent permitted by law, Dahemik shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, resulting from your use of the App.

8. Indemnification

You agree to indemnify, defend, and hold Dahemik harmless from any claims, damages, or expenses, including legal fees, arising out of your use of the App, any breach of these T&C, or your interactions with other users.

9. Modification and Termination
​

  • Changes to Terms: Dahemik reserves the right to modify these T&C at any time. Users will be notified of significant changes, and continued use of the App constitutes acceptance of the revised terms.

  • Termination of Access: We reserve the right to suspend or terminate your access to the App if you violate these T&C or if we deem it necessary for security or operational reasons.

10. Governing Law and Dispute Resolution
​

These T&C shall be governed by the laws of Belgium. Any disputes arising from or relating to these T&C shall be resolved through arbitration or in the appropriate court in Belgium.
